Privacy Notice June 2010
OUR PRIVACY POLICIES AND PRACTICES
PoliSeek (a wholly-owned subsidiary of Mercury Casualty Company) is committed to the highest level of integrity in all our dealings with our clients. This commitment extends to any personal information about you that we might possess or acquire. At PoliSeek, we are dedicated to providing you with the highest quality of service, support, and products while taking appropriate actions and safeguards to protect your personal information. We protect your privacy in accordance with the Gramm-Leach-Bliley Financial Services Modernization Act (GLBA), the Fair Credit Reporting Act (FCRA), as amended by the Fair and Accurate Credit Transactions Act of 2003 (FACT Act), and this Privacy Policy. In addition, when state privacy or other laws may require greater protections of customer information, or as provided by GLBA, PoliSeek will comply with those requirements.
PURPOSE OF THIS NOTICE
Title V of the GLBA generally prohibits any financial institution, directly or through its affiliates, from sharing non-public personal information about you with a non-affiliated third party unless the institution provides you with a notice of its privacy policies and practices, including the type of information that it collects about you and the categories of persons or entities to whom it may be disclosed. In compliance with GLBA, we are providing you with this document, which notifies you of the privacy policies and practices of PoliSeek.
OUR PRIVACY POLICY
We do not sell your information.
  1. Information we collect:
    1. Categories of information collected and sources from which we collect it
      We collect information about you to help us offer better products and services from the broad range available. The following are examples of non-public information about you that we may collect:
      • Information we receive from you on applications and other forms (e.g., name, address, telephone number, social security number, date of birth, length of employment, gender, marital status, prior insurance information and length of residency).
      • Information about your transactions with us, our corporate affiliates and others (e.g., insurance coverage selections and premiums, payment and claims history and information necessary for billing and payment).
      • Information we receive from a consumer reporting agency (e.g., motor vehicle, credit reports and claims history reports).
      • Information we receive in the form of a report that is prepared by an insurance support organization (ISO). Note the ISO may keep the report and give it to others.
    2. Persons from whom information is collected
      We may collect non-public personal information only from those individuals seeking coverage and from public records.
  2. Types of disclosures to third parties:
    We do not share your information with non-affiliated third parties except as allowed or required by law. In the course of our general business practices, we may disclose the information that we collect (as described above) about you or others without your permission to the following types of institutions for the reasons described:
    • To a third party acting on our behalf as necessary to provide products and services you have requested or authorized.
    • To an insurance institution, agent, or credit reporting agency in order to detect or prevent criminal activity, fraud or misrepresentation in connection with an insurance transaction.
    • To an insurance institution, agent, or credit reporting agency for either that agency or the entity to whom we disclose the information to perform a function in connection with your insurance transaction.
    • To an insurance regulatory authority, law enforcement, or other governmental authority in order to protect our interests in preventing or prosecuting fraud, or if we believe that you or others have conducted illegal activities.
    • To a group policyholder for the purpose of reporting claims experience or conducting an audit of our operations or services.
    • To an actuarial or research organization for the purpose of conducting actuarial or research studies.
    • As required or allowed by law.
    • To a party involved in the sale, merger or transfer of our business.
  3. You may request access and amend your personal information:
    You may request access to the personal information that we record about you. The request may include the source of the information and the identity of the persons, institutions or types of institutions to whom we have disclosed such information within two (2) years prior to your request. Your request may also include the right to view such information and copy it in person, or request that a copy of it be sent to you by mail (for which we may charge you a reasonable fee to cover our costs). Your request may also include making corrections, amendments or deletions of any information in our possession. The procedures that you must follow to request access to or an amendment of your information are as follows:

      The request should include your name, address, telephone number, and the recorded information to which you would like access. The request should state whether you would like access in person or a copy of the information sent to you by mail. Upon receipt of your request, we will contact you within thirty (30) business days to arrange for providing you with the access or the copies that you have requested.
    • To correct, amend, or delete any of your information: You should submit a request to the address above.
      The request should include your name, address, telephone number, the specific information in dispute, and the identity of the document or record that contains the disputed information. Upon receipt of your request, we will contact you within thirty (30) business days to notify you either that we have made the correction, amendment or deletion, or that we refuse to do so and the reasons for the refusal, which you will have an opportunity to challenge.
  4. On-Line Data
    For each visitor to our web page, our web server automatically recognizes only the domain name, not the e-mail address (where possible).
    We collect only the domain name; the e-mail addresses of those who communicate with use via e-mail; aggregate information on what pages consumers visit; and information volunteered by the consumer, such as quote requests, survey information and or site registrations.
    The information we collect is not shared with other organizations from commercial purposes. All information that we collect will be used to:
    • Provide insurance quotes requested by consumers, based on the information they have supplied.
    • Maintain communication with prospective customers in order to provide information on new products, services or upcoming events.
    • Improve the content of our web page and to notify consumers about updates to our web site.
  5. Use of Cookies
    When you first visit the web site of PoliSeek, a cookie is sent to your computer. Cookies are very small files sent to your hard drive that essentially identifies your computer and they are important to assist in the collection of vital data, such as your user preferences when visiting our site. We use cookies to improve the quality of our service to you and to better understand how people interact with us. We do not use cookies to access personal information. Rather, it is a tool that we use to compile aggregated statistics that we use to better serve you. Of course, you can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, without cookies, some features or services of the web site may not be available or will be impaired.
  6. Safeguarding Personal Information
    We restrict access to non-public personal information about you to those employees and others who need such information in order to provide products or services to you. Their right to further disclose and use the information is limited by our code of conduct, applicable law and disclosure agreements where appropriate. We maintain physical, electronic, and organizational safeguards that comply with applicable regulatory standards to guard your non-public personal information.
    Our systems are configured to provide privacy, integrity, and authentication in Internet communications. The security measures we have taken help ensure that your data, if submitted to this site, is secure and encrypted, so that a third party cannot capture, read or access the information while it is in transit between your computer and our system.
STATE SPECIFIC REFERENCES

For Minnesota Residents
The disclosure of personal information among PoliSeek and affiliates is authorized under the Minnesota Insurance Fair Information Report Act, § 72A.502, subdivision 8, which allows for disclosure without written authorization where i) the personal information is used for a limited purpose and ii) the affiliate agrees not to disclose the information for any other purpose or to unaffiliated persons.

For Montana Residents
The disclosure of personal information among PoliSeek and affiliates is authorized under Montana's Insurance Information and Privacy Protection Act, MCA 33-19-306 (12)(a) and (b), which allows for disclosure without written authorization where i) the personal information is used in connection with an audit or to enable PoliSeek to perform an insurance function and ii) an appropriate agreement is executed with the affiliate to limit the affiliate's use and disclosure of the personal information.

For New Mexico Residents
We may disclose personal information among PoliSeek and affiliates without written authorization pursuant to New Mexico's Privacy Rule, 13.1.2.1 through 13.1.3.23 NMAC. However, any such disclosure will be only to the extent necessary to effect, administer or enforce a transaction that you have requested or authorized.

For North Dakota Residents
NDCC 26.1-02-27 permits PoliSeek to disclose personal information pursuant to NDCC 45-14-01-11, which sets forth North Dakota's rules promulgated in accordance with NAIC's Privacy of Consumer Financial and Health Information and allows for disclosure where appropriate opt-out notice and opportunity has been given.

For Vermont Residents
PoliSeek is authorized to disclose personal information under Vermont's Privacy of Consumer Financial and Health Information Regulation Article IV, Sections 14(A), (B) and (C), which provide an exception to the general "opt-in" rule where PoliSeek executes an appropriate agreement with the third party limiting use and disclosure of such personal information. PoliSeek is further authorized to disclose personal information under Sections 15(A) and (B) which provide an exception to the "opt-in" requirement where the disclosure of personal information is necessary to affect, administer or enforce a transaction that the customer authorizes. Our release of personal information is also authorized where permitted by law under Section 16(A).
